1. Acceptance of these Terms
These Terms of Service ("Terms") are a binding agreement between you and Cardi LLC, a Delaware limited liability company with its registered office at 8 The Green, Suite A, Dover, DE 19901, United States ("Cardi", "we", "us" or "our").
By downloading, installing, accessing or using the Cardi mobile application, any Cardi experience shown on a TV, the website at getcardi.app, or any related service (together, the "Service"), you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, do not download or use the Service.
2. Eligibility
You may use the Service only if:
- you are old enough to agree to these Terms where you live, or, if you are a minor, your parent or legal guardian has read and agreed to these Terms and permits you to use the Service (the Service is not directed at children under 13);
- you are not barred from receiving the Service under the laws of your jurisdiction or any export, sanctions or trade-control regime; and
- you are physically able to take part in moderate to vigorous exercise, or have been cleared to do so by a medical professional.
If you are a minor, your parent or guardian is responsible for your use of the Service and for any purchases made. We may refuse, suspend or terminate the account of anyone who does not meet these requirements.
3. The Service
Cardi is a motion-controlled fitness game. Your phone's camera reads your movement on the device and turns it into controls for a game shown on your TV (or on your phone, if you play without a TV). The Service also includes personalised plans, estimates of calories burned, calorie and meal logging (including photo-based food recognition), optional Apple Health integration, streaks, weekly leagues, leaderboards, friends and related account features. The app creates an account for you automatically; signing in with Apple is optional. Much of the Service requires a paid subscription. Features may be added, changed or removed at any time.
4. Exercise safety: your responsibilities
You acknowledge and agree that:
- Consult a doctor. The Service is not a substitute for professional medical advice. Talk to a doctor before starting any exercise programme, especially if you have or suspect a medical condition, are pregnant or recently gave birth, take medication that affects your heart rate or blood pressure, or have had an injury.
- Listen to your body. Stop exercising immediately if you feel pain, chest pressure, dizziness, faintness, nausea or unusual shortness of breath, and seek medical help if symptoms continue. You choose how hard to push. Game prompts, timers, streaks and leagues never require you to continue.
- Clear your play space. You are responsible for making sure the area where you play is large enough, free of obstacles and has a non-slip floor, and that nothing and no one (including children and pets) can be hit or tripped over. Wear suitable footwear. Be mindful of neighbours and floors below you when jumping.
- Secure your equipment. Place your phone and TV securely so they cannot fall. Cardi is not responsible for damage to your phone, TV, furniture or home.
- No competing at any cost. Leaderboards, leagues and streaks are for fun. Do not over-exert yourself, exercise while ill or injured, or ignore warning signs to climb a leaderboard or keep a streak.
- Not an emergency service. The Service cannot detect medical emergencies. In an emergency call your local emergency number.
5. Calorie, nutrition and health estimates
Calories burned, calorie budgets, weight-change projections, nutrition values from food recognition and similar figures are estimates for general wellness and entertainment. They are based on your inputs, general formulas, device sensors, Apple Health data and third-party food databases and recognition models, and may be inaccurate. They are not medical, dietary or clinical advice and must not be used to diagnose, treat or manage any condition. If you have, or are recovering from, an eating disorder, or you have diabetes or another condition affected by diet, consult a qualified professional before using calorie-tracking features.
6. Account and acceptable use
You are responsible for the information you provide, for keeping access to your device and your Apple ID secure, and for all activity under your account. Tell us promptly if you suspect unauthorised access.
You agree not to:
- use the Service in violation of any law, regulation or court order;
- impersonate anyone, choose a handle or profile photo that is offensive or misleading, or harass, threaten or abuse other players;
- submit falsified workouts, use recordings, devices, bots or other means to fake movement, or otherwise manipulate distances, leaderboards or leagues;
- reverse engineer, decompile or otherwise try to derive the source code of the Service, except where mandatory law allows it;
- access the Service by automated means, scrape or harvest data, or bypass rate limits, technical protection measures or access controls;
- introduce malware, attack or interfere with the Service or other users' use of it;
- use the Service to build a competing product or to train any machine-learning model.
You can report or block another player in the app. We review reports and may remove results, change handles, reset rankings or disqualify accounts we reasonably believe are cheating or breaking these rules. Runs that go beyond realistic limits for pace, distance, duration or calories are automatically left out of leaderboards and leagues.
We have zero tolerance for objectionable content or abusive users. You must not upload a profile photo or choose a username that is offensive, sexual, violent, hateful, harassing or impersonates someone else. We review reports within 24 hours and remove offending content and accounts.
7. Your content
You keep ownership of the content you submit, such as your meal photos, profile photo, descriptions and logs ("User Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit and process your User Content solely to operate, secure and improve the Service and to show it to other users where the Service's features do so (for example, your @handle, profile photo and kilometres on a leaderboard). You confirm you have the rights to the User Content you submit.
8. Subscriptions, free trials and refunds
Cardi Pro is an auto-renewable subscription sold through the Apple App Store. The price, billing period, what is included and any trial or offer terms are shown in the app before you buy. Current plans:
- Yearly. The yearly price shown in the app is charged to your Apple Account when you confirm the purchase, and every year after that until you cancel.
- Yearly with a free trial. Some users may be offered a yearly plan that starts with a free trial (for example 3 days). Nothing is charged when the trial starts. Unless you cancel at least 24 hours before the trial ends, the yearly price shown in the app is charged when the trial ends, and every year after that.
- Discounted yearly offer. Some users may be shown a discounted yearly plan. Its price is charged to your Apple Account when you confirm the purchase and, unless you cancel, renews every year at the same price shown in the app.
The following standard terms apply to all Cardi subscriptions:
- Payment. Payment is charged to your Apple Account at confirmation of purchase or, if you start with a free trial, when the trial ends. We do not process card payments.
- Auto-renewal. Your subscription renews automatically for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.
- Free trials. Any unused portion of a free trial is forfeited when you purchase a subscription. Trials and introductory offers are available once per Apple ID, as determined by Apple's eligibility rules.
- Managing and cancelling. You can manage your subscription and turn off auto-renewal at any time in your iPhone's Settings → [your name] → Subscriptions after purchase. Cancellation takes effect at the end of the current paid period, and you keep access until then. Deleting the app or your Cardi account does not cancel your subscription.
- Restoring. If you reinstall the app or change devices, use Restore on the subscription screen while signed in to the same Apple ID.
- Refunds. Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com. Where mandatory consumer law in your country gives you a right of withdrawal (for example the 14-day right under EU Directive 2011/83/EU), that right applies, unless you asked for the digital service to start immediately during the withdrawal period and acknowledged that you would lose the right, as permitted by Article 16(m) of that Directive.
- Price changes. We may change prices for future periods. Apple will notify you in advance where required, and you can cancel before the change takes effect.
- Promotional offers. Discounts and one-time offers apply only as described when shown, are non-transferable and have no cash value.
9. Intellectual property
The Service, including its software, game worlds, characters (including the Cardi character), graphics, music, text, logos and the "Cardi" name, is owned by us or our licensors and protected by copyright, trademark and other laws. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your personal, non-commercial use. All rights not expressly granted are reserved.
10. Third-party services
The Service works with third-party services, including Apple (App Store, Sign in with Apple, Apple Health, AirPlay), RevenueCat (subscription management), Edamam (food recognition and nutrition data), Open Food Facts (product data for barcodes, available under the Open Database License), TV and screen-mirroring platforms, and the providers listed in our Privacy Policy. Your use of them is governed by their own terms and privacy policies, and we are not responsible for them. Compatibility with every TV, phone or casting setup is not guaranteed.
11. Account deletion
You may delete your account and associated data at any time in the app (Profile → Account → Delete account, also reachable from the Account link on the subscription screen) or by emailing admin@getcardi.app. Deletion removes your data from our servers, including meal photos, and revokes Sign in with Apple for Cardi. We keep only the limited records described in our Privacy Policy, such as billing records the law requires and player reports. Deleting your account does not cancel an active subscription; manage that in your Apple Account settings.
12. Disclaimers
To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", with all faults and without warranty of any kind, whether express, implied, statutory or otherwise. We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, uninterrupted availability and security.
Without limiting the above, we do not warrant that: (a) the Service will meet your requirements or be available without interruption or error; (b) motion tracking, calorie estimates, nutrition estimates, distances, rankings or any other output will be accurate, complete or reliable; (c) the Service will achieve any particular fitness, weight or health result; or (d) the Service is suitable for any medical, clinical or safety-critical purpose.
You assume all responsibility and risk for your use of the Service and your conduct while using it.
13. Assumption of risk
You understand that physical exercise carries an inherent risk of injury, including strains, sprains, falls, cardiac events and, in rare cases, death. You voluntarily assume all risks of exercising with the Service. Cardi does not supervise you and does not control your health, your fitness level, your play space, your equipment or how hard you exercise. To the extent permitted by law, any injury, illness, property damage or other loss arising from your exercise is your responsibility and not that of Cardi, its officers, employees, contractors, licensors or service providers.
14. Limitation of liability
To the fullest extent permitted by applicable law, in no event will Cardi, its officers, directors, employees, contractors, agents, affiliates, licensors or service providers be liable to you or any third party for any:
- indirect, incidental, special, consequential, exemplary or punitive damages;
- loss of profits, revenue, data, goodwill or anticipated savings;
- personal injury, illness or death, except to the extent caused by our gross negligence or wilful misconduct or where such liability cannot be excluded by mandatory law;
- damage to phones, TVs, furniture, floors or other property;
- damages arising from third-party services, from unauthorised access not caused by our gross negligence, or from your breach of these Terms;
arising out of or in connection with the Service, whether based on warranty, contract, tort (including negligence), strict liability or any other theory, and whether or not we were advised of the possibility of such damages.
Aggregate cap. Our total liability to you for all claims relating to these Terms or the Service will not exceed the greater of (a) the amounts you paid for the Service in the twelve (12) months before the event giving rise to liability, or (b) one hundred U.S. dollars (US$100).
Mandatory carve-outs. Nothing in these Terms excludes or limits our liability for (i) death or personal injury caused by our negligence where such limitation is prohibited by law; (ii) fraud or fraudulent misrepresentation; (iii) gross negligence or wilful misconduct where it cannot be excluded; or (iv) any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions; there, our liability is limited to the smallest extent the law permits.
15. Indemnification
You agree to defend, indemnify and hold harmless Cardi and its officers, directors, employees, contractors, agents, affiliates, licensors and service providers from any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from (a) your use of the Service; (b) your User Content; (c) your breach of these Terms or any law; or (d) injury to any other person or damage to property caused by you while using the Service. This section does not apply to consumers to the extent prohibited by mandatory consumer law.
16. Suspension and termination
We may suspend, restrict or terminate your access to the Service if we reasonably believe you have breached these Terms, that your use poses a safety, security or legal risk, or that the Service is being used unlawfully. Sections that by their nature should survive termination (including Sections 5, 7, 9 and 12–19) survive.
17. Force majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, epidemic, government action, labour disputes, network or power outages, or failure of a third-party service.
18. Governing law and jurisdiction
These Terms and any dispute relating to them or the Service are governed by the laws of the State of Delaware, United States, and applicable U.S. federal law, excluding conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Subject to Section 19, the state and federal courts located in Delaware have exclusive jurisdiction. If you are a consumer living in the European Union, the United Kingdom or another country whose mandatory consumer-protection law lets you bring proceedings at home or rely on that country's law, that right is preserved.
19. Mandatory arbitration and class-action waiver (U.S. users only)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
If you live in the United States or a U.S. territory, you and Cardi agree that any dispute, claim or controversy relating to these Terms, the Service or your relationship with Cardi (a "Dispute") will be resolved by binding individual arbitration and not in court, except that either party may bring a qualifying claim in small-claims court.
Rules. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures (or, at your election, by the American Arbitration Association under its Consumer Arbitration Rules), in English, before a single arbitrator, in the U.S. county where you live or another agreed place, with hearings by video where reasonable.
Class-action waiver. You and Cardi may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, consolidated or representative action. If this waiver is found unenforceable for a claim, that claim must be severed and brought in court, and the rest will proceed in arbitration.
30-day opt-out. You may opt out of this Section 19 by emailing admin@getcardi.app within 30 days of first accepting these Terms, with your name, your Cardi @handle or friend code and a clear statement that you opt out of arbitration.
20. Apple App Store terms and Apple EULA
If you downloaded the app from the Apple App Store, you acknowledge that these Terms are between you and Cardi LLC only, not Apple; that Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it; that, to the maximum extent permitted by law, Apple has no warranty obligation for the app other than refunding the purchase price if the app fails to conform to an applicable warranty; that Apple is not responsible for any product-liability, legal-compliance, consumer-protection or intellectual-property claims relating to the app; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use must also comply with Apple's Usage Rules in the Apple Media Services Terms and Conditions.
These Terms are Cardi's end-user licence agreement and apply in addition to Apple's Licensed Application End User License Agreement ("Standard EULA"). Where these Terms do not address a matter, the Standard EULA applies; where they conflict, these Terms apply to the extent permitted by law and by Apple's rules. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
21. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you in the app or on getcardi.app at least 14 days before it takes effect. If you keep using the Service after that date, you accept the updated Terms; if you do not agree, stop using the Service before then.
22. Miscellaneous
Entire agreement. These Terms, the Privacy Policy and any purchase terms shown at the point of sale are the entire agreement between you and us about the Service.
Severability. If any provision is unenforceable, the rest remains in force and the provision is replaced by an enforceable one closest to its intent.
No waiver. Not enforcing a right is not a waiver of it.
Assignment. You may not transfer these Terms without our written consent. We may assign them in connection with a merger, acquisition, restructuring or sale of assets.
Notices. We may give notice in the app or on getcardi.app.
Usage statistics. To stop the pseudonymous usage statistics described in Section 3.8 of the Privacy Policy, email admin@getcardi.app with your @handle or friend code.
Language. The English version of these Terms controls. Translations are provided for convenience.
